Terms of Service

1. Introduction
Welcome to Tempah ("Platform", "we", "us", "our"), a cloud-based booking and reservation system operated by Azbahri Technologies Enterprise (002968468-T), located at E-20-11, Residensi Pandanmas 2, Kg Pandan, 55100 Kuala Lumpur, Malaysia.
By accessing or using our Platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Platform.
2. Definitions
- "Owner" or "Business Owner": A registered user who creates and manages outlets on the Platform to accept bookings.
- "Guest" or "Customer": An individual who makes a booking through an outlet on the Platform.
- "Outlet": A business entity created by an Owner to accept bookings (e.g., restaurant, event venue, service provider).
- "Booking": A reservation made by a Guest through an Outlet.
- "Subscription Plan": A paid service tier (Free or Pro) that provides access to Platform features.
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use our Platform. By registering, you represent that all information provided is accurate and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
3.3 Business Information
Owners must provide accurate business information including outlet name, contact details, and location. Misrepresentation of business information may result in account suspension.
4. Platform Services
4.1 For Business Owners
The Platform provides:
- Online booking and reservation management system
- Custom subdomain for your booking page (e.g., yourstore.tempah.my)
- Capacity and availability management
- Multiple rate/pricing configuration
- Integration tools to connect your own payment gateway accounts (SecurePay, CHIP, or manual bank transfer)
- Booking notifications and confirmations
- Customer data management
- Menu and photo management
- Embeddable booking widget
- Agent/sales tracking (Pro feature)
- Reporting and analytics
4.2 Customer Data Ownership and Responsibilities
Outlet Owners own their customer data. When guests make bookings through your outlet:
- All customer booking data (names, contact details, booking history, custom fields) belongs to you as the Outlet Owner
- You have full access to view, manage, and export your customer data at any time
- You are the data controller for your customer data and are responsible for complying with applicable data protection laws
- Tempah acts as a data processor, providing the platform to store and manage your customer data
- You may use your customer data for your own business purposes in accordance with your own privacy policy
As an Outlet Owner, you agree to:
- Handle customer data responsibly and in compliance with applicable data protection laws (including PDPA Malaysia)
- Not sell, share, or disclose customer data to third parties without proper consent or legal basis
- Protect customer data from unauthorized access, loss, or misuse
- Use customer data only for legitimate business purposes related to your services
- Respond to customer data access or deletion requests in accordance with applicable laws
- Not use customer data for spam, harassment, or any unlawful purposes
Violation of these data handling obligations may result in account suspension or termination.
4.3 For Guests
Guests can:
- Browse outlet information and availability
- Make bookings with party size selection
- Provide contact information for booking confirmation
- Make payments through the Outlet's chosen payment gateway (payments go directly to the Outlet, not Tempah)
- Receive booking confirmations and tickets via email
Note: When you make a booking, your information becomes the Outlet Owner's customer data. The Outlet Owner is responsible for how they use your data. Please review the Outlet's privacy policy if available.
5. Subscription Plans and Fees
5.1 Plan Types
We offer the following subscription tiers:
- Free Plan: Limited features including 1 outlet, 300 bookings per month, 3 sessions per date, and 60-day advance booking.
- Pro Plan: Full features including up to 3 outlets, unlimited bookings, 100 sessions per date, 365-day advance booking, all themes, agent tracking, and priority support.
5.2 Payment
Pro plan subscriptions require payment via our supported payment channels. Prices are displayed in Malaysian Ringgit (MYR) and include any applicable transaction fees as displayed at checkout.
5.3 Refund Policy
We offer a 7-day refund policy for subscription payments, subject to the following conditions:
- Refund requests must be submitted within 7 days of the payment date.
- Refunds will be processed after deducting:
- Payment gateway transaction fees (non-recoverable)
- Any affiliate/referral commission that has been credited or paid
- Any other applicable processing fees
- Full refunds are not possible due to these deductions.
- Refunds are issued to the original payment method within 14 business days.
- To request a refund, contact us at me@azbahri.my with your transaction details.
5.4 Subscription Renewal
Subscriptions do not auto-renew. You will need to manually renew your subscription before expiration to maintain Pro features.
6. Referral Program
6.1 Referral Code
Each registered user receives a unique referral code that can be shared with others.
6.2 Commission
When a referred user upgrades to a Pro plan using your referral code, you may earn a commission as specified in the current referral program terms. Commission rates are subject to change.
6.3 Commission Withdrawal
Earned commissions can be withdrawn once they reach the minimum withdrawal amount. Withdrawals are processed to your specified bank account within the stated processing time.
6.4 Referral Lock
Once a user upgrades using a referral code, that referrer relationship is permanently locked and cannot be changed.
7. Platform Role and Relationship
7.1 Technology Platform Only
Tempah is a software-as-a-service (SaaS) platform that provides booking and reservation management tools to Business Owners. We are a technology provider only and do not:
- Provide, deliver, or perform any services offered by Outlets
- Employ, control, or supervise Outlet Owners or their staff
- Set prices, availability, or terms for services offered by Outlets
- Guarantee the quality, safety, or legality of services provided by Outlets
- Act as an agent or representative of any Outlet or Guest
7.2 Direct Relationship Between Guest and Outlet
When you make a booking, you enter into a direct contractual relationship with the Outlet Owner, NOT with Tempah. The Outlet Owner is solely responsible for:
- Providing the booked services
- Service quality and customer satisfaction
- Handling complaints, refunds, and disputes
- Compliance with applicable laws and regulations
- Their own terms and conditions, cancellation policies, and refund policies
7.3 Payment Processing
Tempah does NOT process, facilitate, or hold any payments for bookings. We provide integration tools that allow Outlet Owners to connect their own payment gateway accounts (such as SecurePay, CHIP, or manual bank transfer). When you make a payment for a booking:
- The payment is processed directly by the Outlet's chosen payment gateway provider
- Funds are transferred directly to the Outlet Owner by their payment gateway provider
- Tempah does not receive, hold, or have access to these funds
- Payment disputes must be resolved directly with the Outlet Owner or their payment gateway provider
7.4 Independent Business Owners
All Outlet Owners on our Platform are independent business operators. They are not employees, agents, contractors, or partners of Tempah. We do not control their business operations, service delivery, pricing, or customer interactions.
8. Booking Policies
8.1 Booking Confirmation
Bookings may be subject to confirmation by the Outlet Owner. Some outlets require manual approval while others auto-confirm bookings.
8.2 Cancellation
Cancellation policies are set by individual Outlet Owners. Guests should review the outlet's cancellation policy before making a booking. Refund requests for bookings must be directed to the Outlet Owner, not Tempah.
8.3 No-Shows
Outlets may mark bookings as no-show if guests fail to arrive. Repeated no-shows may result in restrictions on future bookings.
8.4 Disputes
Any disputes regarding bookings, services, payments, refunds, or any other matters related to your booking must be resolved directly between you and the Outlet Owner. Tempah is not a party to these disputes and has no obligation to mediate or resolve them.
9. User Conduct
You agree not to:
- Use the Platform for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Submit false or misleading information
- Impersonate any person or entity
- Interfere with or disrupt the Platform's operation
- Attempt to gain unauthorized access to the Platform or other users' accounts
- Use the Platform to send spam or unsolicited communications
- Collect user information without consent
- Upload malicious code or content
10. Intellectual Property
The Platform, including its design, features, and content, is owned by Azbahri Technologies Enterprise. You may not copy, modify, distribute, or create derivative works without our written permission.
Outlet Owners retain ownership of their content (photos, menu items, descriptions) but grant us a license to display this content on the Platform.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided "as is" without warranties of any kind.
- We are not liable for any indirect, incidental, or consequential damages.
- We are not responsible for the actions, services, content, or conduct of any Outlet Owner or Guest.
- We are not responsible for disputes between Guests and Outlets.
- We are not liable for any losses arising from booking cancellations, no-shows, service quality, or payment disputes.
- We are not liable for any issues with payment processing, as payments are handled directly by third-party payment gateway providers chosen by Outlet Owners.
- Our total liability is limited to the amount paid for your subscription in the past 12 months.
12. Indemnification
You agree to indemnify and hold harmless Azbahri Technologies Enterprise, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.
13. Account Suspension and Termination
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent or abusive behavior
- Provide false information
- Fail to pay applicable fees
- Misuse, sell, or improperly handle customer data
- Use customer data for spam, harassment, or unlawful purposes
- Receive complaints regarding data privacy violations
- Engage in activities that harm the Platform's reputation or other users
- Upon your request
Upon termination, your access to the Platform will be revoked. Data retention is subject to our Privacy Policy. We reserve the right to investigate any suspected violations before taking action.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
